1. Scope of application
These Terms of Use govern access to and use of the Websites of European Card Payments Cooperation, a cooperative company headquartered in 1040 Brussels, Rue d’Arlon 82 and registered with Banque Carrefour des Entreprises (RPL Brussels) under no 0746.947.708 (“ECPC”) whose domain names are [●] and all of their sub-domains (“the Websites”).
By consulting the Websites, the user accepts these Conditions of Use, as well as the conditions of Collection of personal [link with Privacy Statement] data, which form an integral part thereof. ECPC will be free to modify them at any time by placing change notifications or links to such notifications directly on the Websites.
2. Accessibility of the sites
ECPC strives, as far as possible, to keep its Websites accessible 7 days a week and 24 hours a day. However, it may interrupt access to them, in particular for reasons of maintenance and upgrading or for any other reason.
ECPC reserves the right to refuse to any Internet user, access to all or part of its site, unilaterally and without prior notification, in particular in the event of violation of the present conditions by a user.
3. Limitation of liability
ECPC is in no way responsible for the interruptions referred to in article 2 and for the damage that such an interruption could cause to a user of the Websites. ECPC makes no warranty as to the accuracy or updating of information on the Websites.
ECPC is not responsible for any damage to data or computer hardware of the user when accessing the Websites, when circulating within their pages or generally during the transmission of files and computer programs that make up the Sites on its reception equipment. In particular, ECPC is not responsible for the possible transmission of viruses through the Websites.
ECPC implements adequate means to prevent illegal intrusions. However, it is not responsible for any fraudulent use of the Websites. It declines any responsibility as for any intrusion in its computer systems and as for any plundering of data which could result from it.
4. Intellectual property
The structure, formatting and all of the elements contained in the Websites are protected by the intellectual property rights of ECPC, its possible suppliers or partners. Other product or company names mentioned on the Websites may constitute the trademarks of their respective owners. The user is not authorized to modify, copy, distribute, transmit, distribute, represent, reproduce, publish, license, transfer or sell any information, software, product or service obtained from the Sites, nor to create works derived from the above, without the prior written consent of ECPC.
5. Links to third party sites
Web spaces outside the domains and sub-domains mentioned in article 1 and, in particular, the spaces to which the user can be directed by means of hypertext links within the pages of this site are the sole responsibility of the holders of these web spaces.
ECPC cannot in fact exercise any permanent control over these sites or assume any responsibility for their content. These sites may be subject to other terms of use. The insertion of these links does not mean that ECPC approves the elements contained on these sites. ECPC therefore declines all responsibility in particular for the material, for the data of any kind contained or disseminated on these referring web spaces, and for the processing of personal data which would be carried out there.
6. Applicable law and competent jurisdiction
Any dispute relating to the use of this site will be exclusively governed by Belgian law. The courts and tribunals of Brussels, sitting in French, have sole jurisdiction to hear any dispute.
In the event of a violation of these Terms of Use, ECPC may sue the User for compensation for his damage.
We know that you can access the Websites in all countries of the world and we cannot prevent it. The Websites have been designed in accordance with Belgian law. If the content or your use of the Website is contrary to the law of the country from which you access it, this Website is not intended for you and we ask you not to use it.
7. Final provisions
If any clause hereof is declared inapplicable, this stipulation will be deemed to be replaced by an applicable clause whose content is as close as possible to that of the original stipulation, and all other clauses will remain in force.
These Terms of Use alone contain the entire agreement between the user and ECPC regarding the Sites.
